The trademarks, logos, and service marks (collectively the "Trademarks") displayed on the Site are registered and unregistered Trademarks of Elite Gates and others. Nothing contained on the Site should be construed as granting, by implication, estoppels, or otherwise, any license or right to use any Trademark displayed on the Site without the written permission of Elite Gates or such third party that may own the Trademarks displayed on the Site. Your misuse of the Trademarks displayed on the Site, or any other content on the Site, except as provided in these Terms and Conditions, is strictly prohibited. 6. Elite Gates has not reviewed all of the websites linked to the Site and is not responsible for the content of any off-Site pages or any other websites linked to the Site. Your linking to any other off-Site pages or other websites is at your own risk. 7. While we are always happy to hear from you, it is Elite Gates' policy not to accept or consider creative materials, ideas, or suggestions other than those we specifically request. This is to avoid any misunderstandings if your ideas are similar to those we have developed independently. Therefore we must request that you do not send to us any original creative materials such as original artwork, written works, etc. Any communication or material you do transmit to the Site by electronic mail or otherwise will be treated as non-confidential and non-proprietary. Elite Gates or its affiliates may use anything you transmit or post for any purpose, including, but not limited to, reproduction, disclosure, transmission, publication, broadcast and posting. Furthermore, Elite Gates is free to use any ideas, concepts, know-how, or techniques contained in any communication you send to the Site for any purpose whatsoever including, but not limited to, developing, manufacturing and marketing products using such information. 8. You agree to indemnify, defend and hold Elite Gates and its affiliates, and their respective officers, directors, owners, agents, information providers and licensors (collectively, the "Indemnified Parties") harmless from and against any and all claims, liability, losses, costs and expenses (including attorneys' fees) incurred by any Indemnified Party in connection with any breach by you of these Terms and Conditions. Elite Gates reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, and in such case, you agree to cooperate with Elite Gates defense of such claim. 9. The Site is controlled and operated by Elite Gates. Elite Gates makes no representation that materials in the Site are appropriate or available for use in locations and countries outside of our business location. Those who choose to access the Site from other locations do so on their own initiative and are responsible for compliance with local laws, if and to the extent local laws are applicable. If any provision of this agreement shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this agreement and shall not affect the validity and enforceability of any remaining provisions. This is the entire agreement between the parties relating to the matters contained herein and shall not be modified except in writing, signed by Elite Gates. Return Policy The original purchaser has a period of 30 days to return any purchase for a full refund, less shipping, handling and any restocking fees. Merchandise must be in new, sealed, re-saleable condition and returned in the original undamaged packaging. All warranty books, instructions manuals, parts and accessories must be included inside the original box in which the item was shipped. To protect the original factory carton from any shipping damages, please place it inside another carton for return shipping. All returns require an advance "RMA"(Returned Merchandise Authorization Number). Please call our office to receive an RMA number before you send your purchased items back to us. Returns without an RMA number will rejected and returned back to you at your cost. When returning a purchased item, customer is responsible for allfreight costs -to us as wells as freight back to you (freight collect) in the event of Rejection, regardless of the original freight fees.Full acceptance of merchandise is final only after our inspection.
In-stock items require a 20% re-stocking fee and Special Order,Out-of-Stock or Bulky items require a 25% re-stocking fee. Merchandise must be received by Elite Gates within 30 days after date of purchase. At our discretion, refunds are issued either by check or credited back to the original account used to charge merchandise, 14 days after approved return. For your protection, most items are shipped with a security seal which once removed, they will not be accepted for return or exchange All warranty issues and defective merchandise must be directed to and handled by the original manufacturer. If requested, we will supply you with any information you may need from us to back up your claims against a manufacturer. Furthermore your input can determine whether we will continue to carry a manufacturers product as when you are unhappy we are unhappy as well.
SORRY, NO RETURNS OR EXCHANGES ON ANY OPEN BOXES. NO EXCEPTIONS TO THIS CONDITION WILL BE GRANTED UNDER ANY CIRCUMSTANCE. Shipping Most orders shipped via UPS Ground. Larger items are shipped by common carrier (trucking company). Most items will be shipped the same business or next business day depending upon the time it was ordered. All shipping charges must be prepaid, no COD. Large items (over 100 lbs or on a pallet) will be shipped by common carrier. A residential delivery surcharge may apply for residential deliveries, such extra charge is the responsibility of the customer and will automaticaly be charged should the customer choose the incorrect shipping method. When common carrier is used, often times the customer is responsible for unloading the items from the truck. In the event a customer refuses shipment after it was shipped from us, the customer will be responsible for all freight charges to and from the shipping location as well as any restocking fee. In the event a customer requests to pick up the shipment at a local freight company terminal and the customer does not pick up the shipment, the customer is responsible for the cost of shipping both to and from the freight terminal, daily storage fees and a restocking fee. You may receive two or three packages to complete a large order. Multiple deliveries do not require any additional shipping charges.
